Details :

The backlashes of Supreme Court decision on Kelo vs New London [2005] in 45 states in the US suggest that applying eminent domains (resumption) for new development not merely for public purposes could be devastating.  Against this background, the situations in the New Territories could be even more complicated as significant portions of privately owned farmlands are collectively held by ancestral hall establishments (Tso and Tong).  New development could well be at the expense of cultural heritage.  In this CPD, the speakers will discuss the problems and suggest some solutions such as land readjustment and land bonds.  They will share the findings of an empirical study in Hung Shui Kiu to illustrate how tapping on privately owned farmlands via land readjustment and lands as opposed to land resumption could arrive at win-win solutions.
